End User License Agreement

NOTICE TO USERS:
CAREFULLY READ THE FOLLOWING LEGAL AGREEMENT.   USE OF THE SOFTWARE PROVIDED WITH THIS AGREEMENT (THE "SOFTWARE") CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS.   IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT PURCHASE, DOWNLOAD, INSTALL AND/OR USE THIS SOFTWARE.   USER'S USE OF THIS SOFTWARE IS CONDITIONED UPON COMPLIANCE BY USER WITH THE TERMS OF THIS AGREEMENT.
OWNERSHIP
Copyright, Title, ownership rights, and intellectual property rights in and for the SOFTWARE shall remain with 'Mystic Fractal' (the AUTHOR).   The SOFTWARE is protected by the copyright laws of the United States and international copyright treaties.   Your license confers no title or ownership in the SOFTWARE and should not be construed as a sale of any right in the SOFTWARE.   The SOFTWARE is licensed, not sold.

Title, ownership rights, and intellectual property rights in and to the content accessed through the SOFTWARE is the property of the applicable content owner and may be protected by applicable copyright or other law.   This License does not provide any rights to Recipient for such content.

Recipient must maintain all copyright notices on all copies of the Software Product.


REGISTERED VERSION
1.   Each registered copy of the software may be used by only one user.   Use of the software means that you have loaded the program and run it, or have installed the program onto a computer.   If you install the software onto a multi-user platform or network, or more than one computer, each and every individual user of the software must be registered separately, or be covered by a site license.

2.   The user is granted full use of any and all images produced by the software for any personal or commercial purposes.   This includes the saved parameter files associated with said images.


UNAUTHORIZED USE
You may not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the software except as provided in this agreement.   Any such unauthorized use shall result in immediate and automatic termination of this license.


WARRANTY DISCLAIMER
The SOFTWARE is supplied "AS IS".   The AUTHOR disclaims all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose.   The user must assume the entire risk of using the SOFTWARE.


DISCLAIMER OF DAMAGES
The AUTHOR assumes no liability for damages, direct or consequential, which may result from the use of the SOFTWARE.   In any event, the author's liability for any claim, whether in contract, tort, or any other theory of liability will not exceed the greater of US $1.00 or license fee paid by you.

The user also agrees that the AUTHOR, and/or any distributors, of the SOFTWARE is not liable for any system crashes due to insufficient memory or occasional program glitches.   The complexity of the routines and algorithms therein is such that no guarantee can be made that the software will run bug-free on all systems all the time, but there will be updates to correct known problems.
